3. Takedown & Dispute Resolution (Mandatory Arbitration)
Overview
Although Roms.by is not subject to U.S. DMCA law, we voluntarily provide a takedown process.
- All copyright disputes must be resolved through binding arbitration conducted under the rules of the International Arbitration Court at the Belarusian Chamber of Commerce and Industry (IAC at BelCCI).
- Requests must include proof of ownership, a description of the allegedly infringing content, and a sworn statement that the request is made in good faith.
- The arbitrator’s decision will be final and binding.
What to Include in a Request
- Your full legal name, company (if applicable), mailing address, and contact email.
- Clear identification (URL and description) of the content you allege is infringing.
- Proof of ownership or authorization to act on behalf of the rights holder.
- A sworn statement that the information in your notice is accurate and that you are the copyright owner or authorized agent, made under penalty of perjury.
Note: Submitting a request does not guarantee removal; the dispute will be handled by the arbitrator.
How Arbitration Works
After we receive a compliant request, we will direct the parties to commence arbitration under the IAC at BelCCI rules. Proceedings are confidential. Each party bears its own costs unless the arbitrator decides otherwise.
No DMCA or copyright-related request will be processed outside this arbitration channel.
4. False or Abusive Claims
Submitting a false, misleading, or abusive takedown request is strictly prohibited. Any party found to have submitted such a claim may be held responsible for all costs incurred in arbitration and may be permanently barred from submitting future claims.
